[Music] hi everyone its Trace McMillan and today we are doing a webinar on separation now lets talk about dividing your assets formally there is no such thing as a gentlemans agreements or an informal division of your assets if you think that there is then you are playing a very dangerous game of Russian Roulette and Ive seen it come back to bite people on the backside many many years later and its not an uncommon experience so lets say you have an agreement between you and your partner you go right okay youre going to keep the house Im going to pay you out a hundred thousand dollars here you go um you forget to transfer the house out of one persons name into the other or lets say you even do do that um and then but you dont go through you dont formalize the the actual agreement um and then lets say five years down the track all of a sudden theres been a property explosion the Markets gone Sky High through the roof which up until covert used to happen um then what happen

In court, the assets will be divided equally between both partners. These measures refer to assets that the spouses jointly own. Such assets include those purchased throughout the marriage, have been purchased using a joint bank account or involve contracts signed by both partners etc.
There is no time limit to that as long as the marriage is not divorced. After the divorce usually a time limit applies. The law does not say for how long the alimony has to be paid. As a rule of thumb spouse support has to be paid for about 1/3 of the duration of the marriage.

A mutual separation contract is an agreement between an employer and an employee. It sets out the term of an amicable separation. Employees agree not to undertake future legal or disciplinary action after their position is terminated, usually in exchange for a severance package.
In a divorce process, the courts and the lawyers service fees should be covered by the couple. The court fees usually amount to 450- 800 ; i.e. you and your partner each have to pay between 225 to 400. To apply for divorce at the Family Court, you also need a lawyer.
As in many other countries, it is usually the wife who initiates divorce proceedings.
