Can a doctor charge me for copies of my medical records or x-rays? Yes, pursuant to Health Safety Code section 123110, a doctor can charge 25 cents per page plus a reasonable clerical fee. For diagnostic films, such as an x-ray, MRI, CT and PET scans, you can be charged the actual cost of copying the films.
If evidence can assuredly point to intentional and knowing acts of violation, the United States Department of Justice can implement a $50,000 fine and one-year imprisonment as a penalty. Deceiving a patient and using false pretenses to access or share their information carries a $100,000 fine and 5 years in prison.
An office may charge a flat fee for patients who are requesting a copy of their medical records. However, this fee cannot exceed $6.50, including postage, labor, and supplies. It is just as important for physicians and staff to know when they cannot charge a patient for a copy of their medical records.
CAN A DOCTOR CHARGE ME FOR MY MEDICAL RECORDS? The doctor may charge you to copy your records. The cost may not be greater than $1.00 per page or $100.00 for the entire record, whichever is less. If your records are no more than 10 pages, the doctor may charge $10.00.
In Illinois, health care facilities and practitioners shall be reimbursed for all reasonable expenses by the person requesting copies of records, including the costs of independent copy service companies, handling charges for processing the request, and the actual postage or shipping charge, if any, plus copy charges.
A covered entity may calculate actual labor costs to fulfill the request, as long as the labor included is only for copying (and/or creating a summary or explanation if the individual chooses to receive a summary or explanation) and the labor rates used are reasonable for such activity.
Rather, charging a flat fee not to exceed $6.50 is an option available to those entities that do not want to go through the process of calculating the actual or average costs for requests for electronic copies of PHI maintained electronically as permitted by the Privacy Rule.
