Can a doctor charge me for copies of my medical records or x-rays? Yes, pursuant to Health Safety Code section 123110, a doctor can charge 25 cents per page plus a reasonable clerical fee. For diagnostic films, such as an x-ray, MRI, CT and PET scans, you can be charged the actual cost of copying the films.
It is important to note that California law differs in this regard. California law allows providers to deny access if the provider determines there is a substantial risk of docHub adverse or detrimental consequences to a patient in seeing or receiving a copy of the records. (Cal. Health Safety Code 123110.)
The HIPAA Privacy Rule permits a covered entity to charge a reasonable, cost-based fee for individuals (or their personal representatives) to receive (or direct to a third party) a copy of the individuals PHI.
