Charging fees, which could represent 10% to 30% of the photo shoot, for cancellations requested within your predefined time frame, such as 12 or 24 hours, is a guarantee that youll never lose 100% of your income.
An average cancellation fee can range from 5-10%, depending on the nature and local laws. To maintain your credibility in the market, you should not charge if someone purchases your products or services by mistake and immediately cancels it since it might ruin your reputation.
A photography usage rights agreement is a contract between a photographer and a client that outlines the terms of use for the photographs taken by the photographer. This type of agreement is typically used when a client hires a photographer to take photos for their business, website, or marketing materials.
Most commercial photographers charge a cancellation fee of 100% of the project-related expenses they incur, and 50% of their Creative Fee (photography + usage fees), for photo shoots that clients cancel. Many photographers also increase the cancellation fee the closer the cancellation date is to the photo shoot date.
Generally speaking, a cancellation fee is not unlawful when (1) it is a fair and reasonable in amount, (2) properly noticed to the consumer, and (3) reflects actual damages suffered by the party charging the amount. But your states law may differ.
By including a liability limitation section in your contract, you protect yourself from unexpected occurrences such as natural disasters, or personal illness. Its also a good idea to state in this section if you will provide a replacement photographer in such cases, and/or provide a full or partial refund.
