There are three types of deeds commonly used to convey land: (1) warranty deed (or a general or full warranty deed); (2) special warranty deed; and (3) quitclaim deed (or a deed without covenants).
A warranty deed is a document sometimes used in real estate, which offers the buyer of property the greatest amount of insurance. It guarantees or warrants that the property is owned by the owner free of any unpaid liens, mortgages, or other obligations against it.
A warranty deed ensures a buyer that the property is owned by the seller and is able to be sold without any encumbrances. A deed of trust is used in certain states, and represents a buyers guarantee with their lender to repay the property loan as scheduled.
As a property owner and grantor, you can obtain a warranty deed for the transfer of real estate through a local realtors office, or with an online search for a template. To make the form legally binding, you must sign it in front of a notary public.
General Warranty Deed in Arizona The deed includes a guarantee from the grantor (seller) that they hold the title free and clear without any encumbrances on the property. This provides the grantee (buyer) the assurance that they can take ownership of the property without any parties making claims to it.
Both a warranty deed and deed of trust are used to transfer the title of a property from one person to another. However, the difference between these two contracts is who is protected. As you now know, a deed of trust protects the beneficiary (lender). A warranty deed, on the other hand, protects the property owner.
A warranty deed makes a promise to the buyer that the seller has good title to the property. A quitclaim deed, on the other hand, makes no promises. A quitclaim deed just says; whatever interest I have in this property, I give to you.
