The New TILA RESPA Integrated Disclosure Rule (TRID) Replaces the Good Faith Estimate (GFE) and Truth-in-Lending Disclosures with a Loan Estimate and Closing Disclosure.
Along with the good faith estimate, the 2015 Truth in Lending Act update replaced another longstanding mortgage information document, the truth in lending disclosure, which helped explain loan details and costs.
The Truth in Lending Act, or TILA, also known as regulation Z, requires lenders to disclose information about all charges and fees associated with a loan. This 1968 federal law was created to promote honesty and clarity by requiring lenders to disclose terms and costs of consumer credit.
The CDF replaces the existing HUD-1 and the final TILA disclosure forms. The new Loan Estimate and Closing Disclosure Form will be used for most consumer mortgages, but not all.
The Consumer Financial Protection Bureau (CFPB) took over administration from HUD and replaced the HUD-1 with the Closing Disclosure in October of 2015. It is similar to the HUD-1 in that it details the loan terms and costs, including the interest rates, closing costs, taxes, monthly payments, and more.
A Truth-in-Lending Disclosure Statement provides information about the costs of your credit. Effective October 3, 2015, for most kinds of mortgage loans a form called the Loan Estimate replaced the initial Truth-in-Lending disclosure, and a Closing Disclosure replaced the final Truth-in-Lending disclosure.
The Loan Estimate combines and replaces the Good Faith Estimate and the initial Truth-in-Lending (TIL) statement.
Todays standard Closing Disclosure replaced the HUD-1 settlement statement as the final document that mortgage borrowers are given before signing closing documents.
