Your Duties and Responsibility as a Commercial Landlord This means that it falls to you to book or conduct an EICR test prior to move in and is not the responsibility of your tenant. To comply with laws, as a landlord, you will need to have your property surveyed with an EICR before it is let to tenants.
Even if carpets, furniture or appliances cannot be cleaned or repaired, your landlord cannot usually charge the full cost of replacement unless: you have not lived there long. the items were new at the start of the tenancy.
My EICR is valid for 10 years, do I need a new one? Older electrical safety certificates may state that they are valid for 10 years, but the new regulations mean that reports carried out over 5 years ago will no longer be valid. If your EICR was attained over 5 years ago you will need a new one.
In July 2020, all new tenancies required an EICR. As of 1st April 2021, this requirement applies to all tenancies new and existing.
An end of tenancy final inspection is known as the check-out. This is the critical final report, prepared at the property on the last day of the tenancy that helps determine whether costs need to be recovered from the deposit.
Landlords repair responsibilities electrical wiring. gas pipes and boilers. heating and hot water. chimneys and ventilation. sinks, baths, toilets, pipes and drains. the structure and exterior of your home, including walls, stairs and bannisters, roof, external doors and windows.
This means that generally you should only need to get one certificate every five years and this certificate can be supplied to any new tenants during that period. The NRLA has received a number of reports of EICRs stating that the report is valid for 5 years or until change of tenancy.
By law, landlords must have an up-to-date EICR for rented properties. While this usually means a new EICR every five years, most letting agents seem to ask for an EICR before a change in tenancy.
If you dont already have a current EICR for a property that you rent out, book an EICR as quickly as possible. EICR are valid for 5 years.
All tenancies will be periodic The Bill proposes to end fixed term tenancies with all tenancies instead becoming periodic from day one. Tenant notice periods of longer than two months would also be banned.
