So lets say youve just submitted a trademark application with the United States patent and trademark office. After you submit it, you realize, oh shoot I made a mistake. A federal trademark lasts 10 years from the date of registration, with 10-year renewal terms. Between the fifth and sixth year after the registration date, the registrant must file an affidavit to state that the mark is still in use.
You must renew your trademark registration between the 9th and 10th year following your registration date, and each successive ten-year period thereafter. If youve exceeded the deadline year by less than 6 months, you may pay an additional fee to file within the USPTO grace period.
If you let your trademark expire, you leave it open for another company or user to register and use it. If the products or services are different than yours, the other company may have an easier time acquiring your trademark.
How can I change the owner address? To change the trademark owners address, use the TEAS Change of Address or Representation (CAR) form.
If your application is abandoned but you still want to pursue a trademark registration, you may be able to revive your application by filing a petition.
A: Correction or change in ownership of a mark is done with a document called an assignment. If there is a co-owner of the mark and youre on good terms with them, have a lawyer prepare an assignment for them to sign, and then record that document with the state or the USPTO (wherever your mark is registered).
How Do I Amend a Trademark Registration? If your trademark registration is not the subject of a cancellation proceeding, then you can amend your trademark registration by filing a Section 7 Request for Amendment with the USPTO. The Section 7 is an online form that is available on the USPTOs website.
A Section 71 declaration is a signed statement filed with the USPTO by the owner of registered extension of protection under the Madrid Protocol (Madrid registration) that either (1) the trademark is in use in commerce or (2) the trademark is not in use in commerce due to special circumstances that excuse use.
You must do these things to maintain your registration: Continue to use your trademark in interstate commerce. File your registration maintenance documents with us, and pay the required fees, at the required times. Keep your correspondence information updated.
In the U.S. joint ownership of a trademark is legal. However, it is contrary to the fundamental trademark policy that a mark should identify and distinguish a single sources goods and/or services.
