One parent can ask for a change (called a modification) in custody or parenting time, or if both parents agree on the change, they can request the change together. If only one person wants to change a judgment on custody or parenting time, file: The Complaint for Modification (CJD 104).
If life circumstances change and the custody order needs to be modified, one party can file a petition to modify custody. To modify custody, they must prove that there has been a material change in circumstances that will impact the childs well-being.
Change or enforce an order. You can change an existing court order or consent order. You can also ask a court to enforce an order if your ex-partner is not following it. If you ask the court to change or enforce an order, youll probably have to go to a court hearing.
Its common for parents to ask at what age their child can decide custody. In Massachusetts, children cant decide where they will live until they are at least 18 years old. However, Massachusetts courts must consider a childs custodial preference when the child is mature enough to have a rational opinion.

Modifying visitation or parenting time A parent may ask the court to modify visitation or parenting time once every two years after the initial child custody order was entered. A parent who appropriately requests a visitation modification does not have to demonstrate a change in circumstances.
Generally, once a court has jurisdiction, that court will keep jurisdiction, even if you move to another state. If you have moved, you can ask the court that issued the original order to transfer the custody case to the new state that you are in.
To change (modify) a Parenting Plan and Parental Responsibility, a parent must list how the childs circumstances have substantially changed and/or how changes in a parents circumstance have substantially impacted the child, and describe how making a change will be good for the child.
