Oregon Rules on Late Fees If you dont pay rent when it is due, the landlord may begin charging you a late fee. Under Oregon law, a landlord must wait four days after the rent due date before imposing a late fee, and must disclose the late fee policy in the rental agreement.
If you do not pay the rent within the 72 hours, your landlord may immediately file a court eviction proceeding. In calculating the 7-day period, the day the rent is due counts. For example, if your rent is due on the first of the month, your landlord may give you a 72-hour notice on the eighth of the month.
After the eviction moratorium ends on October 1, renters have until March 31, 2021 to catch up on any rent payments they missed between April and October 2020. But landlords can give notices of termination or file evictions for other reasons, both during and after the moratorium.
In Oregon, an eviction can take between 30 and 60 days. Things get complicated and drag on longer if the landlord inadvertently gives the tenant a defense for not paying rent.
The housing provider shall serve on the tenant a 30-day notice to vacate. The tenant may be evicted only if the tenant knew or should have known that an illegal act was taking place.
Your rental agreement must describe how the late charge is calculated, the date on which the rent payment is due, and the date on which a late fee becomes due. Your landlord must wait at least four days after rent is due to charge you a late fee.
The landlord must file a notice of restitution and pay a fee. Notice forms are available in the small claims office. The Sheriff or a private process server will serve the tenant with the notice to vacate. The tenant will then have four days to vacate.
Nonpayment of rent is a common reason for an eviction case. Oregon considers nonpayment of rent on the 4th day from the rental period as late. Before a landlord may start the eviction process, they are required to give the tenant an official written eviction notice.
