Use the confirmatory deed to correct an error in a warranty or quitclaim deed in Massachusetts. A corrective or confirmatory deed is in effect an explanation and correction of an error in a prior instrument and passes no title.
If properly executed, a Florida quitclaim deed usually requires two weeks to three months to be recorded. The parties involved in real estate transactions generally seek to record the deed immediately after the closing process is concluded.
When correcting an error in a deed in Illinois, there are two basic options: 1) re-record the original deed with corrections made on the face of it by striking out the wrong item; or 2) record a correction or corrective deed.
Obtain Certified Copy of Deed If you have lost or misplaced your original deed (or other legal document which has been recorded), you can obtain a certified copy from the Recording Office where the original document was recorded. A certified copy has the legal validity of the original document.
There is a four-year statute of limitations for a prior deed to come into the chain of title and take effect.
In order to access a copy of the original deed, you need only conduct a public records search of the applicable county. Each county in Florida has a public records website where you can conduct a search.
A quit claim deed should be filed with the clerk of court in the county where the property is located. This will involve taking the deed to the clerks office and paying the required filing fee (typically about $10 for a one-page quit claim deed).
Florida Quitclaim Deeds Should be Properly Filed To ensure the transfer of a quitclaim deed, the original document should be recorded with the county recorder for the county where the relevant property is located. Until the deed is recorded, it is not valid against third-party interests.
