How Long Does A Father Have To Establish His Paternity? In California, there is no statute of limitations on when a father can establish his paternity. When there is doubt about a childs parentage, the court can order a blood test to establish paternity up to two years following the birth of the child.
Note: There are no fees to amend or correct a birth certificate within one year of the date of birth. After a year, the California Office of Vital Records charges $20 to amend the birth certificate.

Only signing a Voluntary Declaration of Parentage or obtaining a judgment in court legally establishes parentage for the children of unmarried parents. Parents may complete a Declaration at any time after the childs birth, and both parents must voluntarily sign in front of an authorized witness.
You can open a parentage case with the Court. Once the legal parents are established by the Court, follow the procedure on the State Dept. of Public Health website to request that the birth certificate be amended to include the fathers name. You and the other parent can sign a Voluntary Declaration of Parentage .
Adding a Fathers Name Later Submit a copy of the original birth certificate to the Department of Vital Records in your state. Pay the applicable fee. Ask the father to sign an affidavit acknowledging paternity, which will need to be docHubd and submitted.
