What CANNOT be included in a prenuptial agreement? Difference between separate and joint property. Protection measures against any debts that your spouse may have. Provisions around providing for any children from previous relationships.
Even if you have signed a prenup, you can still go to court to settle your finances during your divorce proceedings. Its important to note that the judge will take account of your prenuptial agreement, but they will also investigate its integrity and the circumstances in which it was agreed.
A prenuptial agreement cannot be modified once its been agreed or once youre married. However, postnuptial agreements are a great alternative if you want to change the terms. This is treated in the same way legally as prenuptial agreements but it is created after marriage.
California law does not allow a spouse to include any terms related to child custody, child visitation, or support in a pre-or post-nuptial agreement. The reason for such a rule is that a judge is responsible for making these decisions in a divorce based on the childs best interests.
The most common grounds to dissolve a prenuptial agreement include coercion or duress, unconscionability, and failure to disclose. The courts will generally enforce prenuptial agreements; however, when one or more of these grounds exist, the court may see fit to void all or parts of a prenup.
Bottom line is no prenup is ever 100 percent guaranteed. Admittedly prenups are not perfect and dont account for the passage of time, adding they are invalidated by the court a little less than 50 percent of the time.
A prenuptial agreement can be amended, but any modification must be agreed to by both spouses. Known as an amendment, if both spouses agree as to the changes in the prenup the alteration can be as simple as drafting the amended document and having both spouses sign it.
Several no-fault divorce states, such as California, Nevada, Iowa, and recently Hawaii, refuse to enforce infidelity clauses. The reason is that these clauses essentially punish someone for doing something wrong during the marriage, which is contrary to public policy in a no-fault divorce state.
