Can You Trademark A Last Name? Under federal trademark law, yes - it is possible to get a federal trademark registration from the USPTO on a mark that would be considered primarily merely a surname, or last name, as long as you can establish secondary meaning (also referred to as acquired distinctiveness).
To claim that a mark registered on the Principal Register is now incontestable, you must file a Section 15 declaration once the mark has been in continuous use in commerce for a period of five (5) years after the date of registration, or date of publication under 12(c), and the mark is still in use in commerce.
To transfer ownership or update your information to reflect a legal name change: Use Electronic Trademark Assignment System (ETAS) to request the change. If youre filing a TEAS form within the next week, you may need to manually update the owner information on the TEAS form.
A Section 15 Declaration of Incontestability, while not required, provides important legal defenses for your trademark, your ownership of the mark, and your exclusive rights to use it. It is highly recommended that if you have been using your mark consistently for five years, you file this declaration.
1605.03 Time for Filing Affidavit or Declaration of Incontestability. The owner may not file a 15 affidavit or declaration until the federally registered mark has been in continuous use in commerce for at least five consecutive years after the date of registration.
Change of Owner (Assignment) and Change of Owner Name The original owner should record the assignment or name change with the USPTOs Assignment Recordation Branch by filing a Recordation Cover Sheet along with a copy of the actual assignment or proof of name change.
