Social Security does not consider someone to be disabled solely on the basis of a substance abuse problem. It used to, but a 1996 federal law eliminated alcoholism and addiction as grounds for benefit claims.
Going Above the SSI Income or Asset Limits. If youre receiving SSI and, for any reason, your income or assets rise above the SSI eligibility limit, Social Security will stop your benefits. In 2023, the individual income limit for SSI is $914 per month, and the asset limit is $2,000.
Under SSI, special provisions are applicable to persons classified as alcoholics and drug addicts. A representative payee must be selected, and the SSI check is sent to this person. Treatment for alcoholism or drug addiction is also required if it is available.
Alcoholism and drug addiction claims are evaluated under Listing 12.09 Substance Addiction Disorders. Disability under this section requires behavioral changes or physical changes associated with the regular use of substances that affect the central nervous system.
The current versions of the CCF and ATF specifically permit the use of either the drivers social security number (SSN) or employee identification number (EIN) when completing the CCF or ATF.
A person who has a legally prescribed medication to treat their substance use disorder (such as Suboxone, Methadone, or Vivitrol etc.), and is no longer engaging in the illegal use of drugs is a person with a disability and is protected by the ADA.
If drugs or alcohol are mentioned in your medical records, after making an initial disability decision, Social Security will make a DAA determination to see whether your use of drugs or alcohol is contributing to your disability. If the SSA finds that it is, your disability claim will be denied.
If we find that you are disabled and have medical evidence of your drug addiction or alcoholism, we must determine whether your drug addiction or alcoholism is a contributing factor material to the determination of disability, unless we find that you are eligible for benefits because of your age or blindness.
