If a custody order is already in place, either party can ask the judge to change it by filing a petition for a modification of custody. To modify (change) a custody order, you will need to go to the court that gave you the order, even if you have moved.
Under Pennsylvania law, you can change your custody agreement through two methods: either through a mutual agreement or a court order. If you and your childs other parent can agree on a change in custody, mutually updating your arrangement is likely the more convenient option.
A parenting plan is a written agreement worked out between co-parents that covers the practical issues of parenting. Co-parents are those who share the duties of bringing up children, especially those who are separated or not in a relationship.
A parent has the option of filing an emergency custody order when they feel that their child is in immediate risk of harm. To file is to essentially request for the courts to immediately intervene to place a child in either the petitioning parents custody or someone elses custody until it is safe to lift the order.
If you want to change the custody order, you must take action by filing a petition with the family court usually, the court that issued the original custody order and by proving a material change in circumstances.
The filing fee for a petition to modify is $42.68. If you cannot pay the filing fee, you may ask to be excused from paying the fee by filing a Petition to Proceed In Forma Pauperis (IFP). If you receive public assistance or SSI, bring your public assistance photo ID or proof that you receive SSI. accepted.
If you and your co-parent cannot agree about your custody arrangement, you can petition the court for a change. To do so, you must prepare a schedule you think is in your childs best interests. You will also need to fill out an official petition to modify custody from with the court that initially handled your case.
