If builders contractors and suppliers have not been paid, they can file a mechanics lien on a property to ensure they get paid for their services and materials. When a mechanics lien is filed on a property, the property owner cannot do anything with the land or building. To resume action and discharge the lien, a property owner can get a Discharge of Mechanics Lien Bond. A Discharge of Mechanics Lien Bond allows property owners to do with their property as they would wish as if the lien were not present. The bond guarantees that the property owner will pay the contractor all monies owed upon final determination by the court. If the property owner does not pay the contractor, the contractor is protected by the bond and compensated. In this way, a Discharge of Mechanics Lien Bond does not entirely extinguish the lien; it just removes the lien from the property and places it on the bond. But in general, if youre a property owner: Anyone who works on your construction project or supplies building materials or equipment can file a lien if they dont get paid. It doesnt matter if they have a contract with you, or if they have ever met you.
Court Petition to Release the Property Lien If the lien claimant doesnt remove the invalid lien, and the time has expired to record the mechanics lien and take action to foreclose, you may petition the court for a decree to release the property from the lien.
Lien Release: After a lien has been filed, the California claimant can release or cancel the lien by filing a Mechanics Lien Release form with the county recorders office where the lien was originally recorded.
To receive a partial release of lien, you must provide documentation to prove theres not enough money to pay off all of our state tax lien(s). Typical situations include: A sale (transfer the rights) of the property (short escrow) A short sale (pre-foreclosure)

Under California Civil Code 8400 8494, a property owner can petition the court for a release order, releasing a California mechanics lien from the property. In order to make a petition, the property owner must give the lien claimant 10 days notice, giving them time to release the lien voluntarily.
Every mechanics lien in California must contain the owners name, a general description of the property and location, the name of the hiring party, a description of the work performed and the amount of money owed.
