A cell phone agreement for company use is a contract between an employer and employee, whereby the employer will provide the employee with a company cell phone for business use. Other terms for a cell phone agreement include an employee cell phone policy or company cell phone usage policy.
Cell phones should not be allowed to distract employees from business tasks. They should not be used for surfing the internet or gaming during work hours. Cell phones should never be used while driving, operating equipment, or in any situation where they can cause accidents.
So, here are some tips on how to stay away from your phone while working. Turn On Airplane Mode or Do Not Disturb. Turn Your Phone Off. Put Your Phone in Another Room. Give Your Phone to a Friend or Relative. Use a Productivity App. Turn Off the Wi-Fi. Use an App-Blocking App.
No Exceptions: Employers Must Always Reasonably Reimburse Employees On-the-Job Use of Personal Cell Phones (California) Section 2802 of the California Labor Code requires employers to reimburse their employees for any necessary expenditures or losses that they incur as a direct result of doing their job.
A phone contract is when you pay for the cost of your handset and tariff simultaneously over the course of 12 to 24 months, so the price of your device is spread over the duration of your contract. You pay a fixed amount each month, so you know exactly how much youre paying.
Company phones are for company business only. Some employers may allow employees to also use the phone for personal use, but this will be outlined in the work phone policy. If a phone is used for personal calls the employee pays for all the calls made from their company phone.
Personal devices including phones may not have the advanced security frameworks that company-issued business phones would have. Employees will also be using messaging, social media, entertainment, e-commerce apps etc on the same phone. All these put confidential business information at risk.
You can absolutely refuse to use your personal phone for work. HOWEVER, your job can absolutely require you to provide a phone to work with. So long as it is a listed requirement for the job, they can require you to have a phone to be used for work.
When employees must use their personal cell phones for work-related calls, Labor Code section 2802 requires the employer to reimburse them. Longer Answer with Practice Recommendations: An Employer Must Reimburse An Employee For The Employees Use Of A Personal Cell Phone For Work Related Duties.
Personal use includes checking social media accounts and playing games during working hours. Employees are not expected to use company phones after hours. There is no legal rule that an employee must answer phone calls or emails outside of business hours.
