You can only amend claims to cover features adequately disclosed in your description. In other words, you cannot amend claims to add undisclosed features. Less common are amendments to the specification.
Finally, it is pointed out that an amendment under 37 CFR 1.312 must be filed on or before the date the issue fee is paid, except where the amendment is required by the Office of Data Management, see MPEP 714.16(d), subsection III. An amendment under 37 CFR 1.312 must comply with the provisions of 37 CFR 1.121.
A substitute specification must not contain new matter. The substitute specification must be submitted with markings showing all the changes relative to the immediate prior version of the specification of record. The text of any added subject matter must be shown by underlining the added text.
The complete specification consists of the description, the claims, drawings (if any) and sequence listings (if any). The specification does not include the abstract. Where an abstract is filed with a specification, then the applicant will be required to provide a replacement specification without the abstract.
A substitute specification must not contain new matter. The substitute specification must be submitted with markings showing all the changes relative to the immediate prior version of the specification of record. The text of any added subject matter must be shown by underlining the added text.
To meet utility patent requirements, inventions must be novel, not obvious, statutory, and useful. They must also meet the United States Patent and Trademark Offices written description, enablement, and best mode requirements.
Substitute Statements A substitute statement may be submitted where an inventor is deceased, is legally incapacitated, cannot be found or docHubed after diligent effort, or refuses to execute a declaration. 35 U.S.C. 115(d).
Unfortunately, under United States patent law you can not amend the patent to include the new subject matter reflecting the improvement you made to the invention. You will have to file a new patent application for the improvement to the invention instead of filing an amendment to the patent.
Amending the Specifications Amendments to the specifications -- the written description of the patent -- must be made by adding, replacing or deleting a paragraph, by replacing a section or by a substitute specification.
A substitute specification is a rewritten version of a patent application that includes amendments made after filing, replaces an illegible original, or prepares the papers for printing.
