The Government outlined in the Bill that Section 21 notices are to be replaced with a modern tenancy system. The current Section 8 notice would be more widely used when evicting tenants when the Section 21 notice is abolished. This enables landlords to regain possession of their property under certain circumstances.
Landlord provides a written notice. The landlord files an eviction complaint with the court. Court serves the tenant with Summons and Complaint. Court holds the hearing for the eviction and issues a judgment.
Its illegal for a landlord to evict you without going to court and getting an eviction order first. Your landlord cant do anything that prevents you from having access to your home without an eviction order. Your landlord must not: Use force or threaten to use force to make you leave or keep you out of your home.
Before a landlord can start filing an eviction, the landlord must give the tenant a 10-Day Notice to Quit. This eviction notice allows the tenant 10 days to settle any unpaid rent. The tenant must resolve their nonpayment of rent after the 10 days notice or leave the rental premises.
This means the eviction process will be prolonged. The government has introduced new legislation which means that from 29 August 2020 landlords must provide 6 months notice prior to seeking possession through the courts in most cases, including Section 21 notice and rent arrears under 6 months.
Eviction by bailiffs This process can take several weeks. Most landlords use county court bailiffs. Some use hight court bailiffs, also known as high court enforcement officers (HCEOs). Bailiffs and HCEOs must give you at least 2 weeks notice of the eviction date.
If youre going to be homeless after the eviction, its possible the council will have to rehouse you. If you think the council may have to rehouse you, you shouldnt move out until the council has confirmed theyre going to rehouse you in writing. This might stop them from finding you intentionally homeless.
