hello in this video we will be looking at a declaration of trust a declaration of trust can help you set out the nature of your ownership and what contributions each party made to the deposit or mortgage payments one question often asked is why do they need a declaration of trust quite simply buying property is very expensive so you want certainty around the investment you are making also you can avoid disputes with the person you are buying within the future because you already have a plan in place for if one person wants to sell their share or the property is sold trust deeds are legally binding so it can be enforced in court a declaration of trust goes above what is said in a title deed on the land registry therefore it can be used to determine the true ownership of the house and what proportion each individual party owns you can craft your legal document to suit your needs this can include several things such as confirmation of who paid how much towards the deposit including stamp

Trustees generally do not have the power to change the beneficiary of a trust. The right to add and remove beneficiaries is a power reserved for the grantor of the trust; when the grantor dies, their trust will usually become irrevocable. In other words, their trust will not be able to be modified in any way.
In the trust deed where there is no mention about amendment, the amendment has to be done with the permission of a civil court. Even the Civil Courts do not have unlimited powers of amendment. The Civil Courts permit amendment under the doctrine of Cy pres, which means the original intent of the settlor should prevail.
The trust protector may also be given the authority to alter the beneficial interests in the trust. This may include the power to modify the trust terms, including dispositive provisions; grant, remove or approve how the beneficiaries exercise powers of appointment; and even approve termination of the trust.
Once a California Trust becomes irrevocable, the Trust beneficiaries generally cannot be changed. Thats the good news. The bad news is that there are a few exceptions. The most common exception is called a power of appointment. A power of appointment grants a person the right to change the Trust beneficiaries.
That is, they cannot be normally changed or amended. So, when asking the question can you change beneficiaries in an irrevocable trust? the answer is generally no you normally cannot change the aspects of an irrevocable trust, like changing beneficiaries.
Death of a Trustee) If a Trustee dies and there are remaining Trustees, the surviving Trustees can appoint a replacement. If a Trustee dies and there are no remaining Trustees, the Personal Representatives of the last surviving Trustee can appoint new Trustees.
Even if you want to change the beneficiary on your policy, an irrevocable beneficiary will still be able to receive the death benefit because of the terms of the contract. The only way to remove an irrevocable beneficiary from your policy is for them to agree to forfeit their rights to the money.
