When major modifications are made to the terms of your employment without your approval, the law allows you to resign and seek full severance pay through a constructive dismissal claim.
In California, Employment contracts are legally binding agreements that create the employer-employee relationship. An employment contract can either be created by writing, verbal agreement, or because of implied circumstances.
Sixty years ago, the Supreme Court in NLRB v. Katz, 369 U.S. 736 (1962) held that an employer must refrain from making unilateral changes to employment conditions unless the union first receives notice and opportunity to bargain about the change.
For example, a general flexibility clause might say that an employer can change the terms of a contract, depending on the needs of the business. A specific flexibility clause might say that an employer can change an employees working hours, but only within the business opening hours.
Fundamental changes to the employment such as docHub salary reductions, demotions, and indefinite (unpaid) layoffs are examples of docHub changes that, if made improperly, create the risk of a claim of constructive dismissal.
In order to have an enforceable revision to the employment contract, both parties must receive new consideration. Both the employer and the employee must be receiving something of value that they were not already entitled to before.
Light bulbs: tenants are generally responsible for changing light bulbs, unless doing so requires specialist knowledge or equipment.
Unilateral variation This will normally only apply to certain specified terms in a contract and the changes permitted will often be limited in their scope. This may be commonly found in employment contracts where the employer can change minor terms of the employment unilaterally, such as staff uniform.
