Grants to individuals are considered charitable and in line with 501c3 status as long as the organization can demonstrate that the recipient of funds is in line with the charitys exempt purpose.
The following is an example of a written acknowledgment where a charity accepts contributions in the name of one of its activities: Thank you for your contribution of $250 to (Organization) made in the name of its Kids Families program. No goods or services were provided in exchange for your donation.
Restrictions Are Permanent (Usually) It seems logical that the money could be moved in an emergency. But, the IRS is serious about restricted funds. Improper use can result in severe penalties, or even loss of exempt status. Boards can be sued by donors for misuse of such funds.
501c3 organizations can donate to individuals, but these contributions must be made as grants or scholarships. When offering financial support to an individual, a 501c3 organization must award these gifts to a class of individuals and include an application process for those who would receive the gift.
To avoid actual or perceived conflict, workforce members must avoid accepting gifts or other items of value, including, but not limited to, meals, tickets to events, special favors, loans, discounts, free services, tips, and gratuities.
In some ways, designated funds also behave in this manner. However, the difference between them is that designated funds are set aside for a specific end by the nonprofit itself, while restricted funds are restricted by the donor.
While we recommend sending donation acknowledgment letters to all of your donors, you are legally obligated to send documentation to donors who have given a gift of $250 or more. The IRS requires nonprofit organizations to provide a formal acknowledgment letter to these donors for tax purposes.
What are restricted funds? Restricted funds are any donations made and earmarked for a specific purpose by the donor. Donors have the legal right to restrict the donations they contribute to organizations (typically nonprofits) and require that their gifts be used only for very limited and specific purposes.
