Unless the employment contract states otherwise, an employer cannot unilaterally change the employees terms of employment without providing fresh consideration (ex. compensation, reduced hours, new benefits, etc.). If the employee does not accept the unilateral changes, a constructive dismissal claim is possible.
An employment contract, more commonly referred to as an offer letter is a legally binding agreement which can be created verbally or in writing. During all stages of interaction with a candidate or employee, you may be verbally implying pieces of an employment contract.
Draft a new contract or a termination letter that outlines the changes or the end of the relationship, and request that the employee sign it. Keep a record of all the conversations and correspondence you had with the employee, as well as any evidence or documentation that supports your decision.
Are employment contracts enforceable in Ontario? Employment contracts are generally legally binding in Ontario and serve as formal agreements outlining the terms and conditions of the working relationship between an employer and an employee. Both parties are expected to uphold the terms stipulated within the contract.
Working with your employee to amend their employment contract will require that you give them due consideration something of value for these changes. This may, for example, take the form of a raise or a signing bonus. You should obtain your employees written consent to all changes.
