However, replacing a trust deed is not as simple as creating a new deed. Doing so may result in it being legally deemed that a new trust has been created with consequent tax and stamp duty implications and every effort should be made to avoid this occurring.
What Is Included in a Trust Deed? The identities of the borrower, lender, and trustee. A full description of the property to be placed in trust. Any restrictions or requirements on the use of the property while it is in trust. The terms of the loan, including principal, monthly payments, and interest rate.
In the Wills that Goodwills produces, we recommend that clients who are excluding a beneficiary listed above have an Exclusion Letter prepared. This letter is legally drafted and includes the Testators reasons for excluding that particular beneficiary. The Exclusion Letter is also referenced within the Will.
The most common example of when a declaration of trust is used is the situation where an adult son or daughter borrows money for a deposit on a first house from his or her parents. The parents may have a mortgage already, and the terms of that mortgage prevent them from borrowing under another.
The discretionary power to remove a beneficiary from the Trust must be clearly granted via the Trust Deed. Once it is established that the Trustee has the power to remove a beneficiary from the Trust, the Trustee usually must prepare a Deed of Variation.
Using a beneficiary deed has its drawbacks, such as estate taxes, lack of asset protection, issues with Medicaid eligibility, no automatic transfer, and incapacity not addressed. Problems may also arise regarding the beneficiaries.
You control the trust, and you no longer want a certain beneficiary to ever get any income or capital out of your Family Trust. You are excluding this person. This Deed of Exclusion is for that purpose.
The right to add and remove beneficiaries is a power reserved for the settlor of the trust; when the grantor dies, their trust will usually become irrevocable.
