There exists no federal law that strictly prohibits storing employees photographs in their personnel files. However, there are certainly reasons why employers should either keep photographs separate from personnel information or not keep them at all.
Can my employer force me to promote their products or services on my personal social media accounts? It depends. Most states that have employee social media privacy laws also prohibit your employer from requiring that you market, post, or promote their products or business on your personal social media page.
Can an employer use employees photographs for marketing purposes such as a company web site or promotional literature? There is no federal regulation which specifically prohibits an employer from using employee photos for business purposes including marketing the employers products and services.
Can a business post your picture without permission? Generally, the answer is no. Unless youve signed a waiver or release specifically authorizing your employer to use your image, your boss likely needs your consent before publishing any photos that feature you.
Department of Fair Employment Housing regulations forbid it. Q: If someone sees that ad, what can they do in response? A: If they see such a request in an ad, and they want to apply for the job, they may want to submit an application without a photo and note that the request is not permitted under California (law).
