Each owner of a Tenancy in Common has the right to completely possess the entire property. Under Missouri Law, a deed or other document that creates a Joint Tenancy with Right of Survivorship must clearly state that in the document.
Probate is not necessary. To transfer the deed, the new owner must file specific forms and present a valid death certificate to the land records office of the county where the house is located. In Florida, spouses can own a house under tenancy by the entirety, a form of ownership exclusive to married couples.
A right of survivorship is a right given to one owner to inherit property on another owners death. As the definition implies, a right of survivorship requires at least two owners. If there is only one owner, then there is no other owner that can hold the right to acquire the property at that owners death.
It differs from other types of co-ownership in that the surviving joint tenant immediately becomes the owner of the whole property upon the death of the other joint tenant. This is called a right of survivorship. A joint tenancy between a husband and wife is generally known as a tenancy by the entirety.
In Missouri, an instrument that would create a joint tenancy in any two grantees will also create a tenancy by the entirety if the grantees are husband and wife. In the case of dissolution of marriage, a tenancy by the entirety will be severed.
A joint tenancy creates a right of survivorship, which means that if one party dies, their interest is automatically transferred to the surviving tenant(s). Joint tenancy is different from a tenancy in common, where a deceased tenants share is passed on to their heirs.
Changing the Deed on Your House You need to record a community property with right of survivorship deed with the county assessor. This is a deed in which you and your spouse transfer the property to yourselves as community property with right of survivorship. Consider hiring an attorney.
Disadvantages of community property with a right of survivorship: If a spouse dies having willed a piece of property titled as community property with a right of survivorship to someone other than their spouse, their gift may be deemed invalid.
