Whats a Copyright License Agreement for Artwork? Artists and other creators use copyright protections to keep their work from being used or sold without authorization. A non-exclusive copyright license allows a third-party licensee to use (but not own) a creative work while still protecting the owners copyright.
When an artist creates a painting, the artist owns both the copyright in the artwork, and the physical artwork. Ownership of the copyright is an intellectual property right. Ownership of the physical artwork is a personal property right. A sale of the physical artwork does not transfer the copyrights in the artwork.
If you buy a piece of artwork, you will own the art, but you will not own the copyright to it unless the artist has specifically transferred the copyright to you.
To register your work with the Copyright Office, you must submit an application, the appropriate filing fee, and a copy of the work to be registered. The general rule is that a separate application for registration should be submitted for each work together with the a separate filing fee and deposit copy.
Under current copyright law, the artist generally owns the copyright in work commissioned by a third party, unless they have signed an agreement to the contrary.
