Joint Tenancy Has Some Disadvantages Control Issues. Since every owner has a co-equal share of the asset, any decision must be mutual. Creditor Issues. Relationship Issues. Substitute for Will Issues. Marriage Issues.
You have the following advantages: you avoid probate and your spouse cannot will away his or her ownership to another individual. However, a big disadvantage is that the surviving spouse only receives a step-up in basis on the inherited portion.
The main difference between joint tenants vs community property with right of survivorship lies in how the property is taxed after the death of a spouse.
Property owned jointly with rights of survivorship is treated very much like property owned with multiple beneficiaries. The difference is often in the distribution to remaining owners if one has died. Unless percentage ownership of specific shares is spelled out, only the surviving owners will inherit the property.
You must fill out the form, listing the name of the trust, the name of the trustees (you and your spouse), and the date of the agreement. You should also write that the property is held as community property with right of survivorship.
A joint tenancy creates a right of survivorship, which means that if one party dies, their interest is automatically transferred to the surviving tenant(s). Joint tenancy is different from a tenancy in common, where a deceased tenants share is passed on to their heirs.
Usually, converting separate property to community property involves adding your spouse to the title of your bona fide separately owned property or engaging in activities as illustrated above which tend to allow your spouse to acquire a material interest in such property (quasi-community property).
Changing the Deed on Your House You need to record a community property with right of survivorship deed with the county assessor. This is a deed in which you and your spouse transfer the property to yourselves as community property with right of survivorship. Consider hiring an attorney.
With joint tenancy the right of survivorship is implied, so if one joint tenant dies, the other joint tenant or tenants automatically become the owners of the deceased tenants interest in the property without the property having to pass through probate.
Community property with right of survivorship is a fairly new legal designation and was created by the California legislature just two decades ago in 2001.
