hello landlords lets talk about something scary today I have sometimes encountered some very aggressive tenants in landlord-tenant matters so aggressive that they tell me mr. Garcia Im gonna sue the pants off of your client Im not sure what that means but what I what I do know about an eviction is a countersuit just isnt allowed if they can do that but they have to do it in a separate lawsuit and so the idea that your tenant comes to court and says I dont want to sue for mold and I want to get my rent returned and I dont know how many times I asked them to fix the window that my kid broke you know none of that stuff comes in none of it should come into the court should be diligent in disallowing extrinsic evidence to come in they sometimes do but they shouldnt and so any claims that they might have for offset or for you know non-payment of rent none of that you come up and so these tenants will sometimes bring these things up but none of it is a legitimate thats just not proper

Under California law, landlords of commercial properties can demand that non-paying tenants pay the past due rent and still proceed with an eviction process if tenants do not pay the rent in full amount of the past due rent, or in other words, they pay a partial amount towards their balance.
It takes about 14 to 90 days from the issuance of the Notice to Vacate, depending on the reason for eviction and the lease agreement.
Official Warning The notice you must give a commercial tenant before eviction depends on the violation. For non-payment of rent, you must give the tenant a minimum of three days before eviction. For other bdocHubes of contract, the minimum notice period is 15 days for the warning.
If the tenant is served in person, clearly, the effective date is three days, but if there are other means of service - through the mail, for example - the best practice is to add another five days. If the tenant pays the rent in three days, the matter is done.

Governor Newsoms latest executive order extended eviction moratoriums on commercial landlords through September 30, 2021. Since that date has lapsed, commercial tenants are no longer protected under the expired law and must rely on state and local regulations still in effect.
Under California law, landlords have the right to evict commercial tenants who fail to make rent payments or otherwise bdocHub the lease agreement.
The law normally provides that if the tenant is in violation of the lease, the landlord must give the tenant a 3-day notice to correct the violation to avoid eviction. Commercial leases will often provide that if the tenant is in violation of the lease, a notice of more than 3 days must be given.
