I consent freely and voluntarily to the companys request for a specimen. I hereby release and hold harmless the company and its employees and agents from any liability whatsoever arising from this request to furnish my specimens and the testing of my specimens.
(a) As an employee, you have refused to take a drug test if you: (1) Fail to appear for any test (except a pre-employment test) within a reasonable time, as determined by the employer, consistent with applicable DOT agency regulations, after being directed to do so by the employer.
Invalid Sample The result of a drug test for a urine specimen that contains an unidentified adulterant or an interfering substance, has abnormal physical characteristics, or has an endogenous substance at an abnormal concentration that prevents the laboratory from completing or obtaining a valid drug test result.
Causes of potentially inappropriate negative UDT results include limited assay specificity, absence of drug in the urine, presence of drug in the urine, but below established assay cutoff, specimen manipulation and laboratory error.
49 CFR Part 40, or Part 40 as we call it, is a DOT-wide regulation that states how to conduct testing and how to return employees to safety-sensitive duties after they violate a DOT drug and alcohol regulation. Part 40 applies to all DOT-required testing, regardless of mode of transportation.
If an employee fails a drug test through DISAs program, it will remain on their account indefinitely. Depending on the industry and/or workplace policy, employees have the opportunity to complete a Return-to-Duty test and process.
WorkplaceTesting Explains Rejected for Testing Rejected for testing applies to a specimen bottle, typically containing a urine sample, that fails to meet the requisite standard for approval by a laboratory technician at the time of delivery. A rejected for testing scenario results in a fatal flaw.
Someone committed a fatal flaw; someone failed to correct a correctable flaw in a timely manner; or the lab reported an invalid result. Whatever the reason, the MRO could not use the test to verify a result in any particular way. A cancelled drug test is neither a negative nor positive result.
