How to Modify Your Marital Settlement Agreement or Final Judgment? There are only two ways to modify anything, whether alimony, child support or parenting plan: (1) try to docHub an agreement with other side before filing anything or, when that fails (it usually does) (2) file a petition for modification.
A stipulated judgment usually resolves the case in its entirety, while a settlement agreement may only resolve certain parts of a case.
However, there are times when a court will set aside the settlement, rendering it unenforceable. In Florida, the grounds for setting aside a settlement are fraud, duress, coercion, and unconscionability.
However, if you both change your mind and decide you no longer want to get divorced, the plaintiff can file a Motion to Dismiss that will stop the divorce complaint. However, once the final divorce decree has been issued, you cant reverse the action.
Modifications/Contempt Petitions If you want to modify your divorce decree or if you want to file a contempt petition, there is a filing fee of $366.00.
A substantial change in circumstances may necessitate the modification of a divorce decree. The state of Alabama allows for such modifications to take place whether the original terms were established by mutual agreement or court order.
(1) Except as otherwise provided herein, in all cases in which an appeal is permitted by law as of right to the supreme court or to a court of appeals, the notice of appeal required by Rule 3 shall be filed with the clerk of the trial court within 42 days (6 weeks) of the date of the entry of the judgment or order
Petition to Modify a Divorce Decree. To change or alter what has been ordered in your divorce decree, whether an agreement was docHubed or not, one party must file a Petition to Modify the Decree. If an agreement was docHubed in the divorce, then the petition would be to change or alter certain aspects of the agreement.
