The original owner should record the assignment or name change with the USPTOs Assignment Recordation Branch by filing a Recordation Cover Sheet along with a copy of the actual assignment or proof of name change.
As soon as the company files a patent application, it should obtain an executed assignment from all the inventors with signatures and date of execution. The assignment should explicitly assign to the company the inventors right to claim priority to the application.
Application date is the date on which the patent office received the patent application. Publication date is the date on which the patent application is published (i.e. the information is available to public). This normally occurs 18 months after the priority date.
Each individual inventor may only assign the interest he or she holds; thus, assignment by one joint inventor renders the assignee a partial assignee. A partial assignee likewise may only assign the interest it holds; thus, assignment by a partial assignee renders a subsequent assignee a partial assignee.
Assignments made for value, or with consideration, are irrevocable. This means that the assignor cannot cancel or take back the assignment.
You can change the claims of a patent without filing a new application unless you are making a new claim. If you are making a new claim, you will need to file a new patent application. Federal regulations governing the USPTO provide specific rules for amending patent claims.
Unfortunately, under United States patent law you can not amend the patent to include the new subject matter reflecting the improvement you made to the invention. You will have to file a new patent application for the improvement to the invention instead of filing an amendment to the patent.
Effective Date of Patent Assignment refers to the date of assignment registration of the patents as listed in the Schedule I of the Agreement with the patent offices where the patents were issued after Assignor receives the patent transfer fees under Article 2.2.
