whats up guys hows it going today for anyone whos currently serving in the military or thinking about serving in the military something that every service member is going to have to consider is what are they going to do with their unused leave when they finally decide to separate from the military and because im air force i consulted the air force regs this is air force instruction 36-3003 dated 24 august 2020 and this is for the military leave program if youre one if youre in one of the other branches theres definitely a reg guiding you so if you want you can consult that and for people serving in the military they accumulate 2.5 days of leave per month and normally they can accumulate up to 60 days that normal times would take you two years to accumulate i know because of covid things are a little strange right now but in normal times you can have up to 60 days of leave accumulated and what are you going to do with this leave should you decide to separate or retire from the mi

You may sell back a maximum of 60 days of leave over the course of your military career. Military leave is sold back at your base pay rate and does not include any special pay or allowances.
If there is a legitimate business reason for the layoff and for the selection of the employee on military leave, an employer may be permitted to lay off an employee who is on a military leave of absence under the Uniformed Services Employment and Reemployment Rights Act (USERRA).
SLA days cannot be sold and are lost if not used before their expiration date. By law, 120 days is the maximum leave that can be carried over into a new fiscal year with SLA protection. SLA is the only mechanism by which more than 60 days can be carried over into a new fiscal year.
Generally, only public employers are required to pay for any part of military leave. Private employers may grant annual leave with or without pay and may pay for all or part of the leave.
5 U.S.C. 6323 (a) provides 15 days per fiscal year for active duty, active duty training, and inactive duty training. An employee can carry over a maximum of 15 days into the next fiscal year.
The general rule of thumb is if you have a job waiting on the outside it may be better to sell back your leave, if you dont it may be better to take terminal leave. Lets look at examples, say you are due to get out on September 1. If you sell back your leave you remain on active duty until September 1.
Charging Military Leave. The minimum charge is one hour. An employee is charged military leave only for hours that the employee would have worked and received pay.
Service members are authorized to sell back their military leave, also known as cashing in their leave, when they are discharged from the military under honorable conditions. 37 U.S. Code 501. Leave is valued at 1/30 of base pay per day cashed in.
Transitioning members may sell back any unused leave. Members are authorized to receive a cash payment for any unused leave when they separate from the military if they are retiring or separating with an honorable discharge. You can also take what is known as terminal or separation leave when you are being discharged.
In order to calculate your terminal leave, find the block labeled ETS BAL on your Leave and Earnings Statement (LES). This block estimates how much leave you will have at your date of separation. This is your terminal leave, which is a paid leave granted immediately prior to a military members end of service.
