464(a) permits the plaintiff or defendant to move for permission to file a supplemental complaint or answer. The supplemental pleading must allege facts material to the case that occurred after the previously filed complaint or answer.
The cross-complaint must arise out of the same transaction or occurrence of plaintiffs claim against the defendant. 395. (a) Except as otherwise provided by law and subject to the power of the court to transfer actions or proceedings as provided in this title, the superior court in the county where the defendants or some of them reside at the commencement of the action is the proper court for the trial of the action.
If you file a Cross-Complaint, you have to let the cross-defendant know formally that you are suing. This is called service. You have to have all papers served on every party in the lawsuit. You cannot serve the lawsuit yourself. It must be served by someone who is not a party to the action, at least 18 years old.
