Members of the uniformed services in an ordinary or reenlistment leave status and uniformed services patients on convalescent leave. Members on convalescent leave may not travel overseas unless their leave form is so annotated. Military personnel traveling on permissive temporary duty (TDY) orders for house hunting.
If there is a legitimate business reason for the layoff and for the selection of the employee on military leave, an employer may be permitted to lay off an employee who is on a military leave of absence under the Uniformed Services Employment and Reemployment Rights Act (USERRA).
Prevent firing without cause In addition to being protected from discrimination, employees who take military leave of absence are also protected from retaliation. Employers cannot fire an employee because of military leave.
Convalescent leave is a non-chargeable absence from duty granted to expedite a military members return to full duty after illness, injury or childbirth, typically for 30 days or less. Convalescent leave is directed and approved by a doctor and your commander. It is paid leave that is not charged to your leave balance.
Convalescent leave that is approved by a commander or MTF director may range from 1 day to 30 days. Convalescent leave exceeding 30 days is controlled at the level designated by the Secretary concerned. There is no cumulative limit to the number of days of convalescent leave that may be granted.
A12. Birth parents will be granted 12 weeks of parental leave following a period of convalescent leave, and non-birth parents will be granted 12 weeks of leave following the birth of the child. Adoptive parents and eligible foster parents will also be granted 12 weeks of parental leave.
The memo specifically says that service members who give birth will be authorized 12 weeks of parental leave following a period of convalescence to care for the child. Service members who are the non-birth parent will also be authorized 12 weeks of leave to care for the child.
5 U.S.C. 6323 (a) provides 15 days per fiscal year for active duty, active duty training, and inactive duty training. An employee can carry over a maximum of 15 days into the next fiscal year.
