Trustees generally do not have the power to change the beneficiary of a trust. The right to add and remove beneficiaries is a power reserved for the grantor of the trust; when the grantor dies, their trust will usually become irrevocable. In other words, their trust will not be able to be modified in any way.
In the trust deed where there is no mention about amendment, the amendment has to be done with the permission of a civil court. Even the Civil Courts do not have unlimited powers of amendment. The Civil Courts permit amendment under the doctrine of Cy pres, which means the original intent of the settlor should prevail.
Once a California Trust becomes irrevocable, the Trust beneficiaries generally cannot be changed. Thats the good news. The bad news is that there are a few exceptions. The most common exception is called a power of appointment. A power of appointment grants a person the right to change the Trust beneficiaries.
Can Beneficiaries Waive Their Inheritance? While a trustee cannot usually remove a beneficiary, a beneficiary who does not wish to get an inheritance can remove themselves from the trust distribution.
Usually there are two ways in which a beneficiary can be removed; The beneficiary can sign a legal document renouncing their interest in the Trust assets. The Trustee can use their discretionary power to remove an individual as a beneficiary by following the instructions in the Trust Deed.
The trustee has the power to make management decisions regarding the trust, but the beneficiaries do not wield such power. However, the law gives beneficiaries certain rights, like requesting a trust accounting and receiving assets from the trustee in a timely manner.
If the class of beneficiaries does not extend to that person, you can add a beneficiary by preparing a deed of variation. However, the original trust deed may prohibit certain persons from becoming beneficiaries. In this case, you may not be able to amend the trust deed to add them.
A change to a trust will only be valid where that change is effected in ance with the trust deeds requirements. When effecting a change to a trust, the parties must review those requirements carefully.
