Unless the tenant can justify their actions, changing the locks on the property without the landlords permission is a bdocHub of the tenancy agreement and in a worst-case scenario could be cause for eviction.
You should not change the locks without agreement. You are both legally entitled to possession of the property and both of you can live there.
Most standard tenancy agreements clearly state that a tenant is not allowed to make changes to the rental property without the landlords permission.
Whilst a tenant is in situ in a property, unless it is expressly covered in the tenancy agreement, your tenant does have the right to change the locks, and unfortunately they have no legal obligation to notify you of this, or provide you with a key to the property.
All tenancy agreements should be signed by both the landlord and the tenant before the tenant moves in. A tenancy agreement that hasnt been signed may mean one or both parties are not bound by the terms within it.
The legal position is quite clear tenancy agreements are legally binding and cancelling them before they start is generally not an option. Although civil law doesnt usually provide a cooling off period, which allows either landlord or tenant to change their mind, its still important to look for a fair solution.
Changing the locks if tenants dont pay their rent is considered illegal eviction. The same applies to preventing tenants from entering the property or removing their belongings without permission.
Examples of unfair terms in tenancy agreements require the payment of rent even if the property becomes uninhabitable, for example destroyed by fire. force the tenant to pay the landlords costs in a court case which the landlord has lost and the tenant has won. unreasonably restrict the tenants right to assign.
A tenancy agreement can normally only be changed if both you and your landlord agree. If you both agree, the change should be recorded in writing, either by drawing up a new written document setting out the terms of the tenancy or by amending the existing written tenancy agreement.
