Non-compete clauses have no place in labor markets. These contracts prevent workers from leaving for greener employment pastures and starting their own businesses.
The Federal Trade Commission voted to extend the public comment period for its proposed new rule to ban employers from imposing noncompetes on their workers. With the extension, the FTC will now be accepting comments on the proposed rule until April 19. Originally, the deadline for submitting comments was March 20.
For those who are worried that their restrictive covenants will no longer be enforceable, dont panic. The FTCs proposed rule announced on Jan. 5, 2023, banning non-compete agreements may never become final.
There Is No Legitimate Business Interest Showing that the agreement is not related to a legitimate business interest is the most effective way of getting out of a non-compete contract. The goal of any non-compete agreement is to protect trade secrets.
Noncompete clauses are already banned in several states, including California, where some but not all of the notoriously noncompete-heavy tech companies are based. The FTC estimates the proposed rule could increase wages by $300 billion a year and impact 30 million Americans.
Colorado, Illinois, Maine, Maryland, New Hampshire, Oregon, Rhode Island, Virginia, and Washington prohibit non-compete agreements unless the employee earns above a certain salary threshold. Other states, like Iowa and Kentucky, limit the use of non-competes for certain professions such as healthcare workers.
In certain circumstances, it is possible to find non-compete contract loopholes that may void the contract. For example, if you can prove that you never signed the contract, or if you can prove the contract is against the public interest, you may be able to void the agreement.
The Act provides that, with certain limited exceptions, no person shall enter into, enforce, or attempt to enforce a noncompete agreement with any individual who is employed by, or performs work under contract with, such person with respect to the activities of such person in or affecting commerce.
