Underlying Lease means any present or future ground or overriding or underlying lease and/or grant affecting the Land, the Building and/or the Demised Premises, as the same may from time to time be amended, modified, renewed, extended and/or replaced.
There is no hard and fast rule about the minimum length a lease should be when it is sold. However, a number of buyers will be discouraged from buying a lease that is nearing or less than 80 years in length. When the length of a lease falls below 80 years, the cost of a lease extension increases dramatically.
A lease document should have been given to you with your purchase pack from the solicitor who advised on the purchase. You can also ask the mortgage lender who will have information on your title. Alernatively, you can go to the Land Registry website and search for an entry for your property.
The registry will show who owns the property, the full address of the property, and whether the property is registered as leasehold or freehold.
To find out how long your lease has left to run you can either check with the solicitor who acted when you bought the property or obtain details of you propertys title from the Land Registry.
Underletting (also known as sub-letting) is an alternative route. Underletting means you become a landlord to an undertenant. Your undertenant may take some or all of your premises and they will occupy on the terms of an underlease that you and they enter into.
Landlord: Typically, this is the freeholder but there are situations where your immediate landlord is the head leaseholder, not the freeholder. A head leaseholder will be the leaseholder with the longest lease, who has leased your flat to you and who pays ground rent to the freeholder.
What options do I have for finding out the remaining duration of my lease? There are two main options you have to discover the exact amount of time you have left on your lease; asking your estate agent or searching online and paying a fee for the information.
As a leaseholder there may be restrictions on how and what you can change or alter your leasehold property.
