Is it possible to make more than one variation? Any gift in the Will can only be varied once so if a beneficiary varies their share of the residue it cannot be varied again but another beneficiary could vary their share by a separate deed.
Yes, you can organise a deed of variation before or after a Grant of Probate (which gives you permission to manage the deceaseds estate) has been obtained. Note, however, that there is a deed of variation time limit the variation must be undertaken within two years of the death.
The variation must be made by the individual who benefits, or who would benefit, under the Will or intestacy and who is giving up that benefit. The beneficiary who is redirecting his/her entitlement must sign the deed of variation.
Can I Use A Deed Of Variation To Change Executors? No, you can only use a deed of variation to change how the estate is distributed. You cant use it to remove or replace an executor.
You only need the executors to agree to it, in addition to the relevant beneficiaries, if the variation increases the Inheritance Tax to which the estate of the deceased is liable (which is not normally the case).
Who signs a deed of variation? Any beneficiaries who are worse off as a result of the variation outlined in the deed must agree and sign the document. The personal representatives must also sign if the tax position changes.
Despite what you may think, a deed of variation doesnt need to be officially registered. The beneficiaries of the will, those affected by the changes, and any new inheritors all need to sign the document. After that, the executor of the will the person managing the deceaseds estate must agree to the changes.
If a person dies without a Will (intestate), beneficiaries can make a deed of variation. However, the same rules apply. All beneficiaries who stand to inherit under the laws of intestacy need to agree with any changes in writing.
