Transfers of real property must be in writing and docHubd. Deeds should be recorded in the county where the property is located. To ensure a legal change to the property title, youll want the services of an attorney. A qualified attorney will prepare and file the real estate transfer deed.
A Corrective Deed is used to fix/correct an error on a California deed which has already been recorded. This type of deed does not create a new interest. The Corrective Deed will correct the deed document on the earlier transfer of interest.
The State of California allows property owners to correct their deeds using one of two ways: an affidavit or a correction deed.
You can purchase a deed form from any of the area office supply stores. The deed will need to be signed by the grantor in the presence of a notary and two witnesses. Once you have completed the form properly, you should bring the deed into the Clerks office for recording into the public records.
Grantor(s) Sign in Front of a Notary. The notary will charge a fee for this service. Fill Out the Preliminary Change of Ownership Report (PCOR) Record the Deed and File the PCOR at the Recorders Office. File Reassessment Exclusion Claim, if any, at the Assessors Office.
In order to correct an error on a California deed, you will need to revise or modify the language in the deed to remove the error. If your deed has been signed and recorded, you will need to complete a Correction Deed or a docHubners Affidavit to correct the error.
Perhaps it describes the wrong parcel, or fails to reflect all land purchased in the sale. An error in a legal description of a property has consequences. It can affect taxes. As lenders extend loans based on a percentage of the propertys appraised value, footage mistakes can sink a loan approval.
Minor errors found in legal descriptions can be corrected by a curative notice recorded in the county public records. The legal description may state northeast when it really should have said north.
