U.S. Trademark Law permits amendments to existing trademark registrations, provided that the changes are not a material alteration and do not alter the commercial impression of the trademark.
Once you file your application, you cannot officially add or change any element of a given mark. Simple administrative changes, such as the address of the trademark owner or a transfer of ownership, are possible; however, the trademark itself cannot be modified.
If ownership of the mark has changed you must file an Assignment of Trademark or Service Mark. Registrant must attach a true and correct copy of the original document showing proof of name change, or a copy of the original document filed in another jurisdiction and certified by the filing office of that jurisdiction.
If the trademark owner is the same entity with a different name, the trademark owner should record a name change with the USPTO. An assignment cover sheet should be added to a copy of the corporate documents reflecting the name change, which will all be submitted to the USPTO.
The following factors will be reviewed to determine proper ownership: (1) which party first used the mark on the product or in connection with the services; (2) which partys name appeared with the trademark on packaging and in advertising; (3) which party maintained and controlled the quality of the product or quality
A request to amend a registration may be submitted to request immaterial changes to the mark and/or other information on the registration certificate. NOTE: The correction of a USPTO error that would result in a material change to the registration may not be requested through this form.
A trademark specimen is the proof of such use thats included with an application to the USPTO. A photograph, screen capture, printout or scanned copy showing the use are typical specimens of use.
How Do I Amend a Trademark Registration? If your trademark registration is not the subject of a cancellation proceeding, then you can amend your trademark registration by filing a Section 7 Request for Amendment with the USPTO. The Section 7 is an online form that is available on the USPTOs website.
