Dont sign that employment agreement until you understand these 3 points. Hi, Simon from The Contract Company. -Contracts, thats what we do, all day, every day and sometimes overnight, and weve done a lot of them. Righto, so you wanna know what to look for in that employment agreement before you sign it. Good idea. So there are a couple of key things in an employment agreement you always need to look for. Obviously, theres the basic stuff, right, which I assume youre gonna be all over things like what is your salary? What are your hours for work? And you know, what do you leave entitlements in terms of annual leave and carers leave and that sort of stuff? Those to me are the basics, you will always check that because youre interested. But often what Ive seen clients do when it comes to the other standard stuff in the contract by this guy whatever, that dont really care. Some of the disadvantages of secondments are a lack of motivation when the employee returns to the substantive position as they see this as a demotion. They are not engaged and therefore do not perform as well as they could or would have in the past.
Unfortunately, employers are allowed to make an employee redundant and then hire someone to do the job for lower pay. This would include an apprentice carrying out the role after the previous employee was made redundant. However, they should have offered this role (and the pay) to you before hiring the new person.
What if the employee wants to terminate the secondment? It is not a requirement that the secondee should be able to terminate the arrangement. If it is permitted the terms of return to the original employer should be made clear.
Yup. You would tell your supervisor that while you feel honored to have had the interim role, you dont want to continue that role anymore and to have someone else take it instead. The supervisor will then find someone else to take the interim role.
Can an employee be made redundant while on secondment? The agreement should set out whether the secondees role is to be kept open for them to return to after the secondment. If an employees substantive role is being considered for redundancy, a fair procedure should be followed to avoid unfair dismissal claims.
A formal agreement referred to as a secondment agreement between the employer, secondee, and host is needed to govern the relationship between the employer, secondee, and host. The secondment agreement must take into account the laws of the employers country and the host country.
During the secondment, the employee continues to be employed by their original employer. At the end of the secondment, it is anticipated that the employee will return to their original position.
