Revocable Trust Fund Once assets are placed into it, they can be transferred to any number of designated beneficiaries after the grantors death. Also called a living trust fund, it can be used to transfer assets to children or grandchildren.
The new trustee will need to sign a Consent to Act declaration as the trustee of the trust. This simply means the trustee consents to the appointment and promises to act as the trustee of the trust. Importantly, it is the existing trustee who holds the legal title to trust assets.
Trust agreements usually allow the trustor to remove a trustee, including a successor trustee. This may be done at any time, without the trustee giving reason for the removal. To do so, the trustor executes an amendment to the trust agreement.
The trust may outline a procedure for replacement, but if it does not, the beneficiaries likely will need to petition the court for an appointment to be formalized. Some trusts require beneficiaries to unanimously agree on a replacement trustee. Others give a specific person the authority to make the decision.
Trustees will usually be appointed by the instrument that brings the trust into existence. The trust instrument should also make provision for any additional appointments that may be necessary during the continuance of the trust.
The surviving spouse still has the same power they had before their spouses death to amend the trust or revoke the trust. A revocable trust becomes irrevocable when the second spouse dies. The successor trustee will take over management of the trust, but will not have the power to change it.
Like a will, a living trust can be altered whenever you wish. One of the most attractive features of a revocable living trust is its flexibility: You can change its terms, or end it altogether, at any time.
Its difficult to change an irrevocable trust. In many cases, such changes would require court approval, and then only in very specific circumstances and with the consent of the trusts beneficiaries.
