As part of the military pay and benefits package, military service members earn 30 days of paid leave per year. You start at zero and for every month of military service, 2.5 days of leave get added to your leave account.
Annual Leave: Active duty Soldiers earn 2.5 days of annual (chargeable) leave for each month of service, for a total of 30 days per year. Currently, Soldiers can bank up to 60 days of leave at the end of the fiscal year.
In order to calculate your terminal leave, find the block labeled ETS BAL on your Leave and Earnings Statement (LES). This block estimates how much leave you will have at your date of separation. This is your terminal leave, which is a paid leave granted immediately prior to a military members end of service.
A. 5 U.S.C. 6323 (a) authorizes 120 hours (15 days) of military leave per fiscal year (FY). This type of military leave is applicable to members of the Army, Naval, Marine Corps, Air Force, or the Coast Guard Reserves, including the National Guard of the District of Columbia (DC).
You are authorized to get a cash payment for any unused leave when you separate from the military if you are retiring or separating with an honorable discharge. You are authorized 1/30 of your basic pay for each day of leave you sell back.
If there is a legitimate business reason for the layoff and for the selection of the employee on military leave, an employer may be permitted to lay off an employee who is on a military leave of absence under the Uniformed Services Employment and Reemployment Rights Act (USERRA).
The use of paid time off/vacation benefits is the employees choice for military-related absences. An employer is prohibited from requiring employees to use their leave benefits for a military absence; however, the employer must allow the use of paid leave if an employee requests it. See 20 C.F.R.
Service members are authorized to sell back their military leave, also known as cashing in their leave, when they are discharged from the military under honorable conditions. 37 U.S. Code 501. Leave is valued at 1/30 of base pay per day cashed in.
