What is a Publishing Deal? In general terms, a typical publishing deal involves the assignment of some part of the ownership of your songs to a publishing company in exchange for a share of the royalties received by the publisher for exploitation of the songs.
Here is a simple way of looking at it: Record labels represent specific recordings of songs by artists they have signed. A publisher is responsible for all recordings of a song, including covers by other artists that are released in physical or streaming formats, by their client writers.
A Record Producer may be affiliated with a record label, and have input into the artwork, marketing, and development of an artists career. More commonly, Record Producers work independently. They are usually paid a flat fee and can also receive a share of the royalties from a song or an album.
Their tasks include promoting their catalogs songs to recording artists; licensing compositions for use by films, television, advertisements, and other media; monitoring song usage; and collecting and distributing royalties to clients.
A music publisher invests in songwriters and composers and controls musical compositions, whereas a record company invests in artists and controls master recordings. Not all songwriters and composers are recording artists and many recording artists dont write their own songs.
Music publishers own the rights to songs and control distribution of written compositions on behalf of songwriters. Record labels control a particular recording of a song, track, or sound performance.
While the record deal establishes ownership of and royalties paid on the recordings made by an artist for a record label, the publishing deal is all about exploiting the copyright in the songs themselves (ie, melodies and lyrics), and ensuring that the songwriter gets paid whenever theyre played on the radio, online
