If you are a leaseholder, you cannot change the lease terms without agreeing such change with your landlord. The reason for this is that as the lease is a contract between two parties, the leaseholder and the landlord, both parties must agree to change (referred to also as variation) of the terms of the lease.
This includes things like decorating, painting, kitchen and bathroom refits. Structural alterations, knocking down walls, adding extensions and even changing flooring usually require a freeholders permission, your lease will detail the full extent to what can and cant be done with the freeholders permission.
A tenancy agreement can normally only be changed if both you and your landlord agree. If you both agree, the change should be recorded in writing, either by drawing up a new written document setting out the terms of the tenancy or by amending the existing written tenancy agreement.
As a leaseholder there may be restrictions on how and what you can change or alter your leasehold property. If you wish to make docHub internal changes to the property, add an extension, or change its use (from residential to commercial), you will have to apply to the freeholder (or landlord) for permission.
Firstly, check your lease to see if you are allowed to make any alterations (some leases may stipulate you only need permission for major works involving the structure, plumbing or electrics; others may state you require permission for any work.) If you do require permission, contact your freeholder and provide plans.
Usually, within a lease of a flat, consent will need to be obtained from the Freeholder and/or Management Company to make alterations these include the replacement of windows. Do not change the windows without first checking if consent is needed.
Some minor errors can be corrected with a document called a Deed of Rectification if the landlord and tenant both agree that the current does not reflect their intentions.
Installation of any boiler which requires a new flue exit in an external wall is unlikely to be permitted under the property lease. However, where the new flue exit is required to meet current regulatory standards, we will consider granting Landlords Consent outside of the terms of the lease.
