Youve earned it Use your leave or lose it Typically, if you have accrued more than two months of unused leave, you lose any amount that exceeds 60 days at the end of the fiscal year, Sept. 30. A service member may be authorized to carry over more than 60 days of leave for a period of time.
Do I have to pay an employee on military leave? Federal military leave policy does not require employers to pay employees while they are on military leave. Military leave is unpaid.
The employee must give notice of the need to leave for military service. The notice may be oral; employers are not permitted to demand written notice. The employee must be released from service under honorable conditions.
Leave of Absence for Military Duty means military leave, annual leave, accrued compensatory time, LWOP, or any combination of these, depending on the circumstances and nature of the military duty. Reservists and members of the National Guards are entitled to LWOP, if necessary, to perform military training duties.

Leave is valued at 1/30 of base pay per day cashed in. No other allowances, such as BAH or BAS, are included in the value of leave. 37 U.S. Code 501(b)(1). For enlisted members only, discharge includes the expiration of an enlistment term, even if the member reenlists.
Members may sell back up to 60 days of leave over the span of their career. Members who are approaching transition with extra leave have 3 choices regarding what to do with that leave. They can: (1) use the leave before transition, (2) sell back the leave when they transition (3) take terminal or separation leave.
