A Pet Addendum for a Lease is a document signed by both the landlord and tenant that legally permits a tenant to have a pet in the residence. Why Do I Need a Pet Addendum? When renting property, landlords have complete discretion as to whether or not they allow pets in their residence. If a landlord does allow the tenant to have a pet in the space, a Pet Addendum will list out the requirements for allowing a pet in the home and holds the tenant liable to responsibilities listed in the agreement. What is Included in a Pet Addendum? Pet Addendums are legal documents that list out the pets information as well as certain conditions from the landlord in order for them to allow the pet. The Bill stipulates that landlords should not reasonably refuse a tenants request to keep a pet. It also includes a number of other measures affecting renters and landlords: Pet owners must hold a responsible animal guardianship certificate, signed off by a registered vet.
Some landlords even charge extra rent every month for a pet. Nothing in New York or federal law prohibits such practices. The only exception would be if someone with a disability has a service animal. In that case, charging a fee for it would violate the tenants rights under the Americans with Disabilities Act (ADA).
The Consumer Rights Act 2015 prohibits unfair terms in a contract. This means a blanket ban on keeping pets in a tenancy agreement might be struck out if challenged in court. Alternatively, the tenancy agreement might say the landlords permission should be sought if the tenant intends to keep a pet.
A pet agreement is a contract specifying that a tenant has permission from the landlord to have a pet living on the property.
A lease can sometimes include a leasehold no pets clause, which excludes you from being able to keep pets in the flat which can often lead to a very tough decision to be made when buying the property.
The fee is one-time and non-refundable. The amount you charge should be based on the breed, number and size of pet a tenant has. Generally, the average pet fee in California is between $100 and $400.
Heres an example of a No Pets lease clause: NO PETS ALLOWED. No pets, whether the lessees or not, are permitted anywhere on the property, even temporarily, without the prior written approval of the Lessor.
Here are a few ways you can politely convey this request to someone: Be direct but kind. You can simply say something like, Im sorry, but we have a strict no-pets policy at our home. Offer an explanation. Suggest an alternative. Be firm but understanding.
